Equitable Interest Listing - A listing where a seller is selling only an option or assigning in interest in a contract and does not have legal title to the property.



Section 1.2.2 Equitable Interest Listings


Equitable interest listings entered into the system must be marked Equitable Interest = Yes and a disclaimer will be automatically placed in both the public and agent remarks that reads "This is an equitable interest listing where seller is selling only an option or assigning an interest in a contract and does not have legal title to the property."


Failure to identify an equitable interest listing in the BR MLS is a minor offense and the broker will be fined the following:


1st and 2nd Offenses - $50

3rd Offense - $100

4th Offense - Agent and Broker appear before MLS Board with discipline to be be determined in accordance with BCAR MLS Rules and Regulations Section 7.
